Terms of Service

These terms are an agreement between you and Christmas PFP ("we", "us") for using christmaspfp.com (the "Service"). By using the Service you agree to them. If you don't agree, don't use the Service.

1. Who can use Christmas PFP

You must be at least 13 years old, or older if the law where you live requires it, to use the Service. If you are under 18, you may use the Service only with your parent's or guardian's permission, and a parent or guardian must make any purchase.

2. Guest sessions and accounts

You can make your first PFP without an account; we create a guest session in your browser. Signing in with Google creates an account, and PFPs from your guest session move to it. You are responsible for activity on your account and for keeping your Google account secure.

3. Credits

Each generation ("run") uses one credit and makes up to 4 PFPs to choose from. Guest sessions get one free credit, and accounts signed in with Google get free credits topped up to 1 every month. Runs paid with free credits are made at a lower image quality. We may change the free amounts at any time.
If a generation fails because of an error on our side, the credit is returned automatically.
If a request is blocked by our content filter, the credit is not returned.
Credits have no cash value, can't be transferred or sold, and may expire as described below.
Creating multiple accounts or guest sessions, or otherwise working around our limits to get extra free credits, isn't allowed.

4. Credit packs

We sell one-time credit packs; current prices and the number of credits in a pack are on the pricing page. There are no subscriptions, and nothing renews or charges you again.

Pack credits expire 12 months after your most recent pack purchase.
Free credits are topped up to 1 once a month for signed-in accounts; unused free credits don't add up.
Credits are used in that order: pack credits first, then free credits.
If a payment is refunded, the credits it granted are removed.

Purchases are sold and processed by Waffo.com Limited, our merchant of record, whose buyer terms also apply to your purchase. Refunds: a credit pack can be refunded within 14 days of purchase if none of its credits have been used. This doesn't limit any refund rights you have under the law where you live. To ask for a refund, email support@christmaspfp.com. Prices may change; a change doesn't affect packs you have already bought.

5. Your content

Your photos. You keep ownership of the photos and text you give the Service. You confirm you have the rights to them, and that anyone recognizable in an uploaded photo is you or has agreed to it being used (see section 6).

Your PFPs. As between you and us, you own the profile pictures you generate, to the extent the law allows, and you may use them for personal and commercial purposes, for example as your profile picture on any social or chat app. AI models can produce similar results for different people, so we can't promise your PFP is unique.

License to us. You give us a limited license to store, process and display your inputs and PFPs only to provide the Service to you, for example to generate them, show them in My PFPs and let you download them. We don't use them to train AI models.

6. What you can't upload, generate or do

Only upload photos of yourself, your own pet, or people who have agreed to you using their photo. Don't upload photos of a minor unless you are their parent or legal guardian.

Don't use the Service to create or upload content that:

is sexual, or sexualizes anyone who is or appears to be a minor,
is a sexual, nude or intimate image of a real person,
is hateful, harassing, threatening or promotes violence,
shows gore, blood or graphic violence, such as mutilation, severe injuries or dead bodies,
is illegal or promotes illegal activity,
infringes someone else's copyright, trademark or other rights,
impersonates a real person, or uses someone's likeness without their consent,
is meant to deceive, for example a fake profile, a scam, or an image that falsely shows a real person doing or saying something.

Also don't: use a PFP to harass, bully or embarrass someone, scrape the Service, access it with bots or automated tools, try to get around rate limits, content filters or security measures, or interfere with the Service or other users.

We automatically check text, uploaded photos and every generated image for prohibited content. A result that fails the check is discarded and never shown or stored, and a blocked request still uses its credit. Accounts with repeated blocked requests are suspended automatically. We may also block requests, remove content and suspend or close accounts that break these terms, and we may report content that sexualizes minors to the relevant authorities.

Reporting content. If you find a PFP made with Christmas PFP that uses your face or likeness (or your child's) without consent, breaks these rules, or infringes your rights, email support@christmaspfp.com with a link to or copy of the image and why you are reporting it. We review every report within 3 business days. If it breaks these terms, we remove the content and may suspend the account that made it, and we tell you what we did.

7. AI-generated results

PFPs are generated by AI, using OpenAI's GPT Image 2 model (gpt-image-2). Results can contain mistakes: the person or pet may not look exactly like the photo, and faces, hands, fur or other details can come out wrong or different from what you expected. Check every PFP before you use it. You are responsible for how you use what you generate, including following the rules of the platforms where you post it.

8. Other platforms

The Service links to and works with platforms we don't control, such as Google and the social and chat apps where you use your PFP. Their terms apply to your use of them, and we aren't responsible for their decisions.

9. Changes to the Service and these terms

We may change, suspend or stop any part of the Service. We may update these terms; if a change is significant, we'll tell signed-in users before it takes effect. Continuing to use the Service after that means you accept the updated terms.

10. Ending your use

You can stop using the Service and delete your account any time in Settings → Security. We may suspend or end your access if you break these terms or if we need to for legal reasons.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including that the Service will be uninterrupted or error-free, or that results will meet your needs.

12. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you.
